These Terms of Service ("Terms") govern your access to and use of the AayulHealth platform — including the website, mobile applications, APIs, the Aayul CareU home-care marketplace, and all services offered by AayulHealth IT Private Limited ("Aayul", "we", "us"). By creating an account or using any Aayul service, you agree to these Terms. If you do not agree, do not use our services.
1. Definitions
- "Platform" — the AayulHealth website, mobile apps, and all associated digital services, including the Aayul CareU home-care marketplace.
- "User" — any individual or organisation with an Aayul account.
- "Patient" — a User with a consumer health account (personal or family).
- "Provider" — a User operating as a Doctor, Hospital, Laboratory, Pharmacy, AYUSH Practitioner, or home-care agency/carer on the platform.
- "PHR" — Personal Health Record, your longitudinal health data stored on the platform.
- "Services" — all features and modules available on the platform including consultations, PHR management, AI analytics, emergency SOS, device sync, provider tools, and home-care bookings.
2. Eligibility & Account Registration
- You must be at least 18 years old to create an independent account. Minors may be added as family members under an adult's account.
- You must provide accurate, complete information during registration and keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@aayulhealth.com if you suspect unauthorised access.
- Each account is for a single individual or organisation. You may not share credentials.
- Providers must hold valid, current licences required for their profession (NMC registration for doctors, NABL accreditation for labs, KYC verification for carers, etc.) and keep their Aayul profile compliant at all times.
3. Services & Plans
3.1 What's Included
All 300+ platform features are available on every plan — including the free plan. Subscription tiers differ only in:
- PHR data retention — 1 month (Free) up to unlimited (highest tier).
- Consultation limits — 5 per year (Free) up to unlimited (highest tier).
- Provider plans differ in user counts, branch limits, and order/test volumes as specified in the plan description at time of purchase.
3.2 Free Plan
The Free plan is permanent (not a time-limited trial). Aayul reserves the right to modify free plan limits with 30 days' notice.
3.3 Subscription Plans
- Subscriptions are billed monthly or annually as selected at purchase.
- Annual plans offer a discounted rate. Annual billing is charged upfront for the full year.
- You may cancel your subscription at any time from account settings. Cancellation takes effect at the end of the current billing period. You retain access to paid features until that date.
- Aayul does not offer pro-rated refunds for mid-period cancellations except as required by applicable law or at Aayul's sole discretion in exceptional circumstances.
- Prices are in Indian Rupees (INR) and include applicable GST unless otherwise stated.
3.4 Add-On Modules
Specialised modules (Women's Health, Chronic Care, AYUSH) may be available as optional add-ons billed separately. Add-ons are subject to the same cancellation policy as base subscriptions.
3.5 Home Care (Aayul CareU)
Home-care visits (nursing, attendants, physiotherapy and related services) are booked through the Aayul CareU marketplace and delivered by independent, KYC-verified carers and agencies. Booking, payment, cancellation and refund of home-care visits are additionally governed by our Cancellation & Refund Policy. Aayul facilitates the booking and payment but is not the clinical provider of the visit.
4. Medical Disclaimer
Important: Aayul is a health technology platform — not a medical provider. The information, AI insights, wellness scores, and analytics provided through the platform are for informational purposes only and do not constitute medical advice, diagnosis, or treatment.
- Always consult a qualified, licensed healthcare professional before making medical decisions.
- AI analytics, predictive risk scores, and anomaly detection are decision-support tools — they are not replacements for clinical judgement.
- AYUSH treatment tracking and traditional medicine data on the platform represents user-reported and practitioner-documented information. Aayul does not validate the medical efficacy of traditional treatments.
- Doctors, labs, pharmacies, and home-care providers on the platform are independent professionals and organisations. Aayul is not responsible for their clinical decisions, prescriptions, test results, dispensing, or care delivery.
5. Emergency SOS
- The Emergency SOS feature is intended to assist in genuine medical emergencies. Misuse or false activations may result in account suspension and potential liability for emergency response costs.
- SOS activation requires an active internet connection and GPS permissions. Aayul cannot guarantee response times as these depend on third-party emergency services.
- By enabling SOS, you consent to your GPS location and Medical ID being shared with ambulance crews and receiving hospitals during an active emergency event.
- Aayul is not liable for delays or failures by emergency responders, hospitals, or ambulance services — these are independent third parties.
6. Family Health Hub
- The account holder ("primary user") is responsible for all data entered for family members, including minors, and for obtaining any consent required on their behalf.
- Family members with their own Aayul accounts can manage consent from their own account settings.
- Removing a family member from your hub does not delete their underlying health data if they have their own account — it only removes your shared access.
7. Provider Responsibilities
- Providers are solely responsible for the accuracy of their clinical decisions, prescriptions, test results, dispensing actions, and care delivery.
- Providers must maintain valid professional licences and notify Aayul immediately if a licence is suspended or revoked.
- Providers must not use the platform to conduct any activity that violates Indian medical council regulations, ABDM guidelines, drug control laws, or pharmacy licensing requirements.
- Prescription data is automatically shared with the patient's PHR and the designated pharmacy. Providers must ensure prescriptions are accurate and appropriate before issuing.
- Labs must maintain NABL or equivalent accreditation as required by the platform's verification standards. Lapsed accreditation may result in removal from the patient-facing directory.
8. Prohibited Uses
You must not:
- Submit false, misleading, or fabricated health data.
- Use the platform to prescribe, dispense, or recommend treatments without the appropriate licence.
- Attempt to access another user's data without their explicit consent.
- Reverse-engineer, scrape, or copy platform data or algorithms.
- Use the platform in ways that violate any applicable Indian law, including the DPDP Act 2023, IT Act 2000, Drugs and Cosmetics Act, or Indian Medical Council regulations.
- Transmit malware, engage in denial-of-service attacks, or interfere with platform infrastructure.
- Create multiple accounts to circumvent plan limits or access restrictions.
9. Intellectual Property
All platform software, AI models, algorithms, design, and content (excluding your personal health data) are owned by AayulHealth IT Private Limited. You receive a limited, non-exclusive, non-transferable licence to use the platform solely for your personal or organisational health management purposes.
Your health data remains yours. Aayul claims no ownership over your PHR. You can export your data at any time.
10. Availability & Changes
- We aim for high availability but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance.
- Aayul may add, modify, or discontinue features with reasonable notice. Material changes to paid plan features will be notified at least 30 days in advance.
- We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on severity.
11. Limitation of Liability
To the maximum extent permitted by Indian law:
- Aayul is not liable for clinical outcomes resulting from actions taken by doctors, labs, pharmacies, home-care providers, or other providers on the platform.
- Aayul is not liable for indirect, incidental, or consequential damages arising from platform use or inability to use the platform.
- Aayul's total liability for any claim arising from these Terms shall not exceed the subscription fees paid by you in the 3 months preceding the claim.
- These limitations do not apply to liability for death or personal injury caused by Aayul's negligence, or for fraud or fraudulent misrepresentation.
12. Governing Law & Disputes
These Terms are governed by the laws of India. Any dispute arising from or related to these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts at Chennai, Tamil Nadu, India.
13. Changes to These Terms
We will notify you of material changes to these Terms at least 14 days before they take effect via email and an in-app notification. Continued use of the platform after the effective date constitutes acceptance. For minor changes (grammar, clarifications with no substantive effect), we may update without advance notice.
